Those couples who are about to enter a divorce may discover that there are many laws that can impact how a divorce plays out. Some of these laws may be obvious, while others may prove challenging to comprehend. Child custody is among the most contentious divorce components that Texas residents may have to face. Divorcing parents may have may questions as to what laws impact child custody cases.

In Texas, child custody is referred to by the law as “conservatorship.” There are many ways in which the law can impact child custody cases in Texas. Parents may choose to file a parenting plan or, in the absence of such a plan, courts may decide on a custody arrangement. Like many other states, the court is required to consider the wishes of the child when making a determination. A number of other factors are also considered. These include whether the parent will encourage a relationship between the child and the other parent. How much each parent contributed to the child’s upbringing will also be considered.

In addition, the courts will look at whether or not joint custody would benefit the child’s emotional, physical and psychological wellbeing. Whether or not the parents can communication effectively in order to make decisions that will benefit the child’s best interests will also be looked at.

Knowing how the various laws involved in child custody cases might impact a court ruling can prove to be helpful in many cases. Some of these laws may be highly complex, making it difficult for parents to understand without the help of an attorney.
