Dallas Guardianships Attorney

Control Who makes Decisions for You

You can protect your right to choose who will act for you when you cannot act for yourself. People who cannot make decisions for themselves require a guardian to act in their best interests. A court will appoint a guardian for you, if they find you failed to name one yourself. By naming a guardian in advance, you maintain control over who will make these decisions.

At the Law Offices of Mary Ann Beaty, P.C., located in Dallas, Texas, we advise people about guardianship for both adults and minors. Contact attorney Beaty to learn more.

Adult Guardianship

People suffer a variety of mental conditions and physical injuries that affect their ability to make decisions for themselves. Important decisions need to be made, even after you lack the ability to do so. When this occurs, you need a guardianship in which a person will make decisions for you.

Our firm will assist you in appointing the appropriate guardian for your situation. Guardians may be of the person or of the estate. A guardian of the person has the authority to make decisions about your personal affairs when you suffer from a diminished capacity. A guardian of the estate makes decisions about your estate, trust, and other property issues.

Guardianship for Minors

A guardian of a child is different from a person who has custody over a child. A person who has custody over a child makes decisions about a child's upbringing and daily needs. Children need guardians when they receive a lump sum of money from either an inheritance or a legal judgment. These guardianships regulate the finances of a ward. A probate court will appoint a legal guardian to oversee this money, until the minor reaches adulthood.

A parent may also name a temporary guardian over a child who will make decisions about healthcare, education, and other important issues concerning a child. This is important when a child lives away from home, or is traveling with another adult.
